EPWater is a municipal water utility and is considered a government entity. As a government entity EPWater has government immunity and is generally not responsible for the payment of property damage claims that are a result of the following:
- natural occurring water main breaks
- sewer backups
- driving over water valve lid or manhole cover
This is not an all-inclusive list but merely serves as an example.
When Is El Paso Water Liable for Damages?
El Paso Water (EPWater), as a governmental entity, is subject to the Texas Tort Claims Act (TTCA). Under the TTCA, governmental immunity is waived in certain situations when EPWater is performing a governmental function.
EPWater may be liable for:
(1) property damage, personal injury, and death proximately caused by the wrongful act or omission or the negligence of an employee acting within his scope of employment if:
(A) the property damage, personal injury, or death arises from the operation or use of a motor-driven vehicle or motor-driven equipment; and
(B) the employee would be personally liable to the claimant according to Texas law; and
(2) personal injury and death so caused by a condition or use of tangible personal or real property if the governmental unit would, were it a private person, be liable to the claimant according to Texas law.
How to File a Claim
To file a claim with EPWater, follow these steps:
1. Write a letter that includes:
- Date, time, and location of the incident
- Detailed description of what happened and damages or injuries
- Names of any witnesses and treating doctors (if applicable)
2. Include these documents:
- Three property damage estimates
- Photos of the damage (if available)
- Accident report (if available)
- Copy of vehicle title (if applicable)
- Medical bills and doctor’s narrative (for injury claims)

What Happens After You File
- Your claim will be assigned to a claims representative.
- An investigation may include a third-party inspection.
- Any unauthorized offers or statements made before final determination are not binding.
- If another party is found liable, you’ll be notified.
Caution: Refusing inspection or investigation may lead to a denial of your claim.
